CORONAVIRUS UPDATE - testing of employees

Dear clients,

the Ministry of Health issued the expected emergency measures concerning:

• employee testing (full text here) with effect from 22 November 2021, with the first testing date no later than 29 November 2021;

• Restrictions on retail sales of goods and services (full text here) with effect from 11 November 2021.

EMPLOYEE TESTING

As of 29 November 2021, at the latest, all employers are now obliged to ensure regular testing of employees, with a frequency of 1x per week, as follows:

• at the workplace;

• by self-used antigen test or an antigen test by a health service provider.

Employees are obliged to take the test at the employer's request.

The following exceptions to this obligation are provided:

• Employees who, due to the nature of their work, do not come into contact with third parties at the workplace (exemption of persons from the same household);

• vaccinated persons (14 days after completion of the vaccination schedule);

• persons with laboratory-confirmed COVID-19 (no more than 180 days have elapsed since the first positive test);

• persons who have had an RT-PCR or rapid antigen test performed by a health care professional within the past 7 days with a negative result.

The employee must prove above mentioned exception to the employer.

If the employee refuses to take the test = the employer shall report this fact to the public health authority and issue an organisational measure according to which the employee's meetings with other persons shall be limited to the necessary extent. / The employee must wear respiratory protection at all times in the workplace, keep at least 1.5 m apart from others and eat separately.

Employers are required to keep a record of testing, including the employee's name and result of testing.

RETAIL AND SERVICES

Retail

• 1 customer per 10m2 of sales area;

• Maintain 1.5 m spacing;

• queue management;

• disinfectants;

• informing customers of the rules;

• maximum possible air circulation.

Congresses / educational events / performances / sports matches

If more than 20 people are present, spectators are prohibited unless they meet the following conditions:

• RT-PCR test prior to 72 hours (applies only to - persons under 18 years of age; persons with contraindications to vaccination persons vaccinated);

• the person is vaccinated and 14 days have elapsed since the completion of the vaccination schedule;

• persons with laboratory confirmed COVID-19 (not more than 180 days have elapsed since the first positive test);

The organiser is obliged to check compliance with these conditions at the time of entry and not to admit persons who do not prove compliance.
