CORONAVIRUS UPDATE - TESTING OF EMPLOYEES

Dear clients,

we recently informed you about the mandatory testing of employees (here), which has changed with effect from today, i.e. March 9, 2021.

EXTENSION OF THE SCOPE OF TESTED PERSONS AND PERSONS NOT NEEDED TO TEST

The amendment to the Extraordinary Measure (available here) specifies that the following are also considered to be employees (who are obliged to undergo testing upon request):

- seconded staff from employment agencies;

- other persons who, on the basis of a legal relationship other than an employment relationship, perform work or similar activities at the employer's workplace together with his employees.

To the contrary, there are no longer required to undergo testing, employees who:

have a certificate issued by the Ministry of Health of the Czech Republic for vaccination against COVID-19 (and at least 14 days have elapsed since the second dose of the vaccine in the case of a two-dose schedule according to the Summary of Product Characteristics, or at least 14 days have elapsed) and the vaccinated person does not show any signs of COVID-19.

This fact, as well as the past COVID-19 disease in the last 90 days (since the positive test) or passing the test other than during the "testing by the employer," the employee confirms with a certificate issued by the healthcare provider.

OBLIGATION OF THE EMPLOYER

The extraordinary measure (available here) newly stipulates the employer's already fulfilled obligation to keep records of tests performed on employees.

During the confirmatory RT-PCR test, which the employee undergoes after a self-test with a "positive result", the employer's ID number will also be recorded.

TESTING PUBLIC EMPLOYERS

There is also a new obligation to test employees of public employers in the case of employment of more than 50 people - no later than on March 17, 2021 (Details in the full text of the measure here).
