Dear clients,
With effect from today (20 December 2021), the obligation regarding employee testing has been clarified as follows (full text here):
• Employees who have taken/been tested with a positive result must immediately notify the employer of their planned absence from the workplace and submit to a confirmatory test without undue delay;
• the period between the discovery of the positive test result (see above) and the receipt of the confirmatory test result is considered to be an obstacle on the part of the employer (Art. 208 of the Labour Code) for as long as it is not another important obstacle to work on the part of the employee;
• the employer is obliged to issue a written confirmation to the employee with a positive test result (sample confirmation here - page 3).
