Dear clients,
we immediately inform you that a few hours ago, the Extraordinary Measure No. 15/2020 of the Regional Hygiene Station of the Moravian-Silesian Region in Ostrava, was issued with immediate effect on the entire territory of the Moravian-Silesian Region and below we bring you a summary of responsibilities that you need to be careful about.
Commuters
The obligation of all employers in the Moravian-Silesian Region to prevent entry to the workplace of cross-border workers who do not submit once every 14 days a medical certificate of passing the PRC test for SARS-CoV-2 with a negative result (max. 4 days old) has been renewed.
This obligation applies only to employees – not to EU citizens who enter the territory of the Czech Republic for the purpose of performing economic activities.
Although RHS MSR has been briefed by many employers and also through our law firm by numerous letters about the internal contradictions, ambiguity and general inconceivability of the previous emergency measures, the new emergency measure has not changed in this respect and moreover is applicable to the whole region.
It is still unclear who bears the cost of testing. We therefore consider the information provided by SÚIP and RHS MSR presented in our latest coronavirus update to be up-to-date and should therefore be defensible, no matter how the employers decide on the costs.
We would like to point out that the newly issued emergency measure is effective today, i.e. using a strict interpretation, a negative test (not older than 4 days) should be submitted by the workers of the next shift. With the previous change of measure the RHS MSR held the interpretation that for the first period the test according rules of previous measure is sufficient, this kind of interpretation was not made yet for new measure. We are closely monitoring the situation and in the event that anything is issued by RHS MSR about this ambiguity, we will of course inform you.
Further measures
• ban of movement and residence of all persons without respiratory protective equipment (nose, mouth) - in all interiors of buildings outside the residence and in motor vehicles – with some exceptions, such as:
- works that are included in a category other than the first in terms of heat load factor;
- an employee while working in one place, if he works at a distance of at least 2 meters from another person;
- employees in offices if they are at a minimum distance of 2 meters from each other;
- on meetings, sessions and similar events of constitutional bodies, public authorities, courts and other public persons, which take place on the basis of law.
• a ban on the presence of the public in catering establishments from 23:00 to 08:00, including the outdoor premises of the establishment;
• restrictions on holding mass events - 100 people in one sector (max. Number of sectors is 5);
• employers are, if possible, obliged to ensure in the production company, where employees meet each other when changing shifts, that previous or subsequent shifts do not meet (at the premises and workplaces of the given production company);
• avoidance, if possible, of contact of employees with employees of individual production plants and workplaces of the given enterprise at a risk distance of less than 2 m within one shift.
